In using this website you are deemed, represented you have read and agreed to the following terms and conditions.

1. Who we are?

• We are AluPlus Hardware Enterprise Sdn Bhd, (Company Registration No. 202403073275 (JR0160915-W)), having our business address at A-01-03, PANGSAPURI SRI TERATAI, LEBUHRAYA BUKIT JALIL, BANDAR PUCHONG JAYA, 47170, Puchong.
• These Terms and Conditions are our copyrighted intellectual property. For the commercial purposes of offering goods and/or services is not permitted.

2. Definition

In these Terms and Conditions:

• “Account” means the AluPlus Account that you will need to register on our Platform if you would like to submit an Order;
• “Business Day” means a day from 9.00 a.m. to 6.00 p.m. in Malaysia, excluding Saturdays, Sundays, and gazetted public holidays;
• “Contract” means your Order of a Product or Products in accordance with these Terms and Conditions which we accept in accordance with clause 6.2 below
• “Customer” means any individual who places an Order on the Platform
• “Order” means the Order submitted by you to the Platform to purchase a Product from us;
• “Order Acknowledgemnet” means our email to you, in which we acknowledge your Order in accordance with clause 6.2 below
• “Platform” means collectively AluPlus Website, and any other websites or applications which we may own or operate from time to time, each of which shall be described as a “Platform”
• “Product” means any product available for sale to Customers on the Platform
• “Website” means the AluPus website accessed at the following address at www.aluplus.com.my;
• “You” means the Customer or a guest;

3. Prohibitions

• Misuse of our Platform is strictly prohibited. You are prohibited from utilizing any automated systems or software to extract data from this Platform for any purpose. Additionally, engaging in or promoting criminal activities, transmitting viruses such as Trojan horses, worms, or logic bombs, posting malicious, technologically harmful, confidential breach, offensive, or obscene material on the Platform, hacking into, corrupting data, causing annoyance to other users, infringing upon the proprietary rights of others, sending unsolicited advertising or promotional material, or attempting to disrupt the performance or functionality of any computer facilities accessed through the Platform are strictly forbidden. Any violation of this provision constitutes an offense under Section 233 of the Communications and Multimedia Act 1998. Should such a breach occur, AluPlus will promptly report it to the relevant law enforcement authorities, and appropriate legal action will be pursued.

4. Entire Agreements

• Section 4.1:
  These Terms and Conditions govern your utilization of the Platform as well as all Orders and Contracts established or to be established by us for the sale and provision of Products. They represent the complete agreement between you and AluPlus, overriding any prior agreements, whether contemporaneous or preceding, between us.
• Section 4.2:
  Upon entering into this Contract, you acknowledge that neither party has relied on any representations, undertakings, or promises made by the other, nor any implications from prior communications between you and us, unless explicitly outlined in these Terms and Conditions.

5. Terms of Sales

• 5.1 Registration
  (a) In order to place an Order, you must register with us by creating an Account on the Platform. It is essential that the information you provide is accurate and truthful. You are also responsible for maintaining up-to-date information by promptly updating any changes through the relevant sections of the Platform.
  (b) It is prohibited to misuse the Platform by creating multiple user accounts.
• 5.2 Formation of a Contract
  (a) The information presented in the Terms and Conditions and the details available on the Platform do not constitute a sales offer but rather an invitation to treat. A Contract for any Products is only established once we have dispatched the Products to your address.
  (b) To place an Order, you must follow the online shopping process on the Platform. Subsequently, you will receive an Order Acknowledgment confirming receipt of your Order. It’s important to note that the Order Acknowledgment does not signify acceptance of your Order by us.
  (c) Our acceptance of your Order occurs only when the Order is dispatched to the provided delivery address, at which point you will receive an email notification confirming shipment. Please refer to the Platform for updates on your Order status.
• 5.3 Mistaken Orders
  (a) Mistaken Orders If you realize that you’ve made an error with your Order after submitting it to the Platform, please promptly contact support@aluplus.com. We will endeavour to assist you with your request.
• 5.4 Refusal of Order
  (a) We retain the right to withdraw any Products from the Platform or modify any materials or content on the Platform at any time. While we strive to fulfil all Orders, there may be exceptional circumstances where we may need to decline processing an Order after sending you an Order Acknowledgment, which we reserve the right to do at our discretion.
  (b) In the event of Order cancellation after you’ve made payment, we will fully refund the payment amount.
  (c) We are not liable to you or any third party for withdrawing any Product from the Platform, regardless of whether it has been sold, altering or removing any materials or content on the Platform, or for declining to process or accept an Order.

6. Products, Content and Specifications

• 6.1: Amendment Clause
  All information, features, specifications, products, and prices displayed on this Platform, www.aluplus.com, are subject to modification without prior notice.
• 6.2: Approximation Disclaimer
  Weights, measurements, and similar descriptions provided on this Platform are approximate and intended solely for convenience.
• 6.3: Color Representation Disclaimer
  AluPlus Hardware Enterprise (“AluPlus”), the operator of this Website, endeavors to accurately depict product attributes, including color options. However, the actual perception of colors may vary based on individual computer systems, and precise color representation cannot be guaranteed.
• 6.4: Availability Disclaimer
  The presence of any products or services on this Platform at a specific time does not imply or assure their availability at other times.
• 6.5: Legal Compliance Clause
  It is the responsibility of the user to comply with all applicable local, state, federal, and international laws, including minimum age requirements, concerning the possession, usage, and sale of any items obtained from this Platform.
• 6.6: Lawful Use Representation
  By placing an order, the user affirms that the products purchased will be utilized in accordance with the law.

7. Accuracy of Billing and Account Information

• 7.1: Order Refusal and Quantity Limitation
  We retain the right to decline any order placed with us. We may, at our sole discretion, impose limitations or cancel quantities purchased per person, per household, or per order. These limitations may encompass orders placed under the same customer account, utilizing the same credit card, and/or orders using identical billing and/or shipping addresses.
• 7.2: Notification of Order Changes or Cancellations
  In the event of a change to or cancellation of an order, we may endeavor to inform you by contacting the email and/or billing address/phone number provided at the time the order was placed.
• 7.3: Prohibition of Certain Orders
  We reserve the right to restrict or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.
• 7.4: Responsibility for Accurate Information
  By agreeing to these terms, you affirm to provide current, complete, and accurate purchase and account information for all transactions conducted at our store. You also agree to promptly update your account and other information, including email addresses and credit card details, to facilitate the completion of transactions and enable us to contact you as necessary.

  Nothing contained on this Platform should be interpreted as granting, by implication or otherwise, any license or right to use any trademarks, trade names, service marks, or logos displayed on this Platform without the written permission of AluPlus or the respective owner.

Furthermore, it shall not in any way alter or diminish our or your rights under these Terms and Conditions or a Contract.

12. Disclaimer of Warranties, Limitation of Liability

• We cannot guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. Similarly, we do not warrant the accuracy or reliability of the results obtained from the service. You acknowledge that we may remove or cancel the service at any time, without prior notice.
• Your use of the service is at your sole risk. The service, along with all products and services delivered through it, are provided “as is” and “as available” without any representation, warranties, or conditions of any kind, whether express or implied. This includes but is not limited to implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
